AES seeks an attorney with 7 to 10+ years of experience in FERC-regulated industries to provide advice and counsel to its U.S. Utilities and Generation businesses (US SBU). This position reports to the US SBU General Counsel and provides in-house support to a variety of AES enterprises ranging from traditional electric utility companies to independent power producers. Office locations for this position include Dayton OH, Indianapolis IN, or Arlington VA. The company also is currently using hybrid remote working.
This position will serve as the primary legal support for Federal Energy Regulatory Commission (“FERC”) matters, including drafting applications, commenting on proposed rules and regulations, making or assisting with periodic FERC compliance filings, advising businesses on legal/regulatory opportunities and risks, participating in administrative proceedings, and handling related matters. In addition to direct representation, Regulatory Counsel also manages outside counsel who may be assigned from time to time to such matters.
A substantial amount of regulatory work will be from AES’s two transmission-owning electric utilities: The Dayton Power and Light Company d/b/a AES Ohio, which is a member of PJM Interconnection, LLC (“PJM”), and Indianapolis Power & Light Company d/b/a AES Indiana, which is a member of the Midcontinent Independent System Operator, Inc. (“MISO”). These utilities have over 1 million customers and are leading energy transitions with major smart grid implementation, customer value, sustainability, and workforce initiatives. Regulatory counsel also will support other independent generation facilities located throughout the U.S., including renewable generation facilities in AES’ Clean Energy business unit. Experience working with PJM. MISO, or other Regional Transmission Organizations and Independent System Operators (RTOs) is preferred as Regulatory Counsel will also provide legal support to internal RTO efforts, including in collaboration with AES’ Clean Energy business unit.
In additional to Federal and RTO level work, Regulatory Counsel may also assist AES counsel who are primarily responsible for State regulatory matters in Ohio or Indiana. Additionally, because there is often an overlap between regulatory matters and commercial matters, Regulatory Counsel may assist with energy related agreements and other matters.
J.D. from an accredited law school and licensed to practice law in at least one state.
Seven to ten+ years of experience as an attorney working on Federal Energy Regulatory Commission matters, in particular for transmission-owning utilities; experience with PJM, MISO or other RTOs is preferred.
