IIs it illegal for a former employer who locked us out of our paystubs and w2s prior to a layoff...to only provide 8 paystubs and only the last w2?
I was laid off, but before they notified us they locked us out of being able to download our w2s and paystubs. Now I don't know what my cobra will be, as they said it's based on what we paid while an employee...I asked for the paystubs for this year for taxes and to see what my cobra will be...but when I asked for them via a ticketing system...they are refusing to provide more than 8 docs. That includes my w2 and paystubs. So I can get my last w2 but then I can only got 7 paystubs which us 2months of paystubs.
This feels like it should be illegal if not by law but the IRS seems like they should not like this either? Is it illegal?
Also, my former employer is saying I won't get my severance for at least a month and still hadn't given me my last 2 patchecks...this feels illegal. Anyone have any thoughts?
Just for clarity, my ex-employer said our COBRA will be what we paid per paycheck for medical insurance.
They call it "subsidized cobra"...so I wanted my paystubs to see what that was as an average so I can plan to pay for it myself. And they have yet to tell me what my cogra cost will be....
You should have 14 months access due to taxes, etc. Also your former employer should want to give you access in the event you move and need t update your address so that your W2 for this year gets sent out to the correct address. File EEOC this concern. Now, if your facilitator for payroll was like a company ADP you should always have access to that outside vendor anyways.
Just go to you state's EEOC and file a complaint.

Ask the EEOC in your state on what the employer needs to legally provide to you. You won't know your COBRA from your paystubs. You will get a separate notification with what that cost will be. If your employer was paying a portion of your insurance, it will be much higher paying it independently.
