Have been through a very similar situation and yes, this person leaving involved a mediated agreement between legal teams. Definitely follow HR on this one. We had to do extensive documentation and it took quite a while to finalize departure. I have no doubt the employee believes 100% they were discriminated against for race rather than the well-documented pattern of unprofessional behavior and incompetence. But I also feel confident that if it had gone to court, we would have been vindicated on the reasons for dismissal. There's only so much you can do.
