Some states have laws barring potential employers from even asking you about your past/current salary. However this varies by state. Regardless, it's not appropriate, especially if there is no written offer which has been accepted.

I am not familiar with US law on employment - however by the comments of others it appears that it is not appropriate for them to be making this request. It might be prudent for you to liaise with the HR and determine exactly what the purpose is of them needing this information. It does seem strange that they would ask these questions after making an unofficial offer though. I would have expected these things to have been vetted by the recruiter(internal or external ) prior to forwarding your resume to their client and prior to any interviewing processes being conducted. Recruitment protocols globally are pretty much the same and one of the first things a recruiter needs to determine is the eligibility of a candidate to in fact take up a position on offer. This include but is not limited to legitimate and verifiable qualifications, work permits, experience, criminal records etc , etc. The fact that they are vetting these things after the fact is a little worrisome, since they have already created a reasonable expectation of employment and this can be considered not acting in good faith. Salary advices( paystubs) should not determine the eligibility of employment because this position has been budgeted for. This budget has been signed off at the highest levels and therefore the salary on offer should have been matched to your expectations based on the initial prerequisites. If you fell outside the mandated budget why did they go through the recruitment process at all. They are either willing to employ you at the budgeted amount or not - what has your previous income got to do with anything? Their internal processes regarding remuneration structures is going to happen irrespective of what you had in a previous company so non of that should matter. Question: Is it possible that they are trying to back out of making an official offer now because someone dropped the ball along the way and they are now looking to rescind the offer and use your lack of compliance to submit "necessary documentation" as an excuse to back out?Just wondering?

If you are a US citizen then I don't believe this is acceptable BUT I am not a lawyer nor am I in NY so I might be very wrong. If you are not a US Citizen then the company may be looking into what it would cost them to employ a non-US citizen. One of my former organizations had to engage a consultant (lawyer??) to help them through this process when bringing in some employees from our Danish headquarters. I wouldn't respond that you won't provide but rather express that you need to understand the specific need for said Personally Identified Information (PII). You don't want to raise a red flag so they don't hire you - especially if they are trying to get permission from the state to hire you BUT you do need to know where you PII is being used and why.

Jennifer, thank you for your response. I am very confused with the request from the legal department of the new company. I will decline to send across my pay stubs. But can I refer them to something that is officially written somewhere that it is not legal for potential employer to ask for pay stubs.

I don't believe it's legal for a potential employer to ask for your paystubs. I would definitely decline. They wouldn't need that information if you are providing other proof that you are legally able to work in the U.S.
