I have an employee who dislikes me, has since the moment I was hired. This employee believes they don’t need supervision and especially seems to have an issue working for a woman and one who is younger. Over the past five years, this employee has made discriminatory remarks towards an LGBT coworker, made disparaging remarks about me to coworkers and on more than one occasion has directly disobeyed safety rules. This individual has access to a secure area and has taken a non authorized employee of the opposite gender into this area for lunch repeatedly. HR has been informed of all of these infractions and declined to ever formally speak with this person or write them up.
For a variety of performance reasons, this individual was passed over for a raise this year and they have filed an age discrimination complaint against me which HR said they are obligated to investigate and put in my record.
I provided all of the back up for why this individual was not given a raise which had all been approved by my supervisor.
I was told yesterday there is no evidence of age discrimination on my part but they will give the person the raise to avoid a law suit.
I feel like I have been hung out to dry. The HR Manager and this individual have worked together for 30 years at this company and I can see that is more important than facts.
Did I do anything wrong here? Will this discrimination report ever be shared outside the company? Can I be terminated for this?
