Violation of the American with Disabilities Act (ADA)?
I'm a woman in her 50's who has been working as a marketing manager for a major packaged goods company. In several months, I will have been with the company for four years. I was hired as part of a large team for a product introduction. Last year I had a stroke which affected me physically and also left me with cognitive deficits. I had no risk factors. I was in the hospital for a week and transferred to a rehabilitation center for almost a month. I've pretty much recovered physically, but I'm still struggling cognitively and also with fatigue. I started back at work part-time and I'm working with a specialist to help me increase my hours. Apparently not fast enough for my company. Last week I received an e-mail, that stated if I'm not back at work full-time by the date of my stroke then they will cut off my disability pay - which is what I'm still receiving for time I'm not working. Recovery from a stroke is very individualized. How can they put a time limit on it? Does this violate the tenets of the ADA?
