I was laid off in December and my separation agreement included 6 months of pay and a portion of my health insurance premium. I signed the agreement that prevents me from filing a legal claim against them. My severance is paid bi-weekly, directly deposited into my account with my portion of the health insurance deducted. I received a note a week ago that the payment for 2/12 will be delayed, they don't have a payment date but they are encountering unforeseen financial challenges.
I am floored, having singed the agreement am I in violation if I file a complaint with my state or talk to a lawyer? I have received 3 of the payments, the 12th would be my 4th. They are scheduled to continue through May.

If they agreed to the number of payments and their schedule then they are in breach of the Agreement you signed. Severance is not mandated by the state. But you can seek out an attorney to write a demand letter and threaten legal action for breach.

Sounds like your severance agreement is a written contract between you and your former employer. I would consult an employment law attorney in your area to assist.
