I'm sorry, but if you're on a 1099/contract you are not an employee. You work according to your business schedule. Sounds like you might have been wrapped up in a company that is trying to make 1099 workers employees without benefits. You, your own company, is the one that assigns your benefits, not the company you're contracted with.
