HELP! Is That Even Legal

Yep, it’s me again! Fired from my job last week for the lamest reason ever! I needed out anyway it was a toxic environment! My employment was terminated on 9/2, I received my COBRA letter on 9/11. The letter stated my insurance coverage was good through 9/30 and COBRA would start on 10/1 if I elected ($1,145 Month!!). When I went to refill a Rx my insurance was denied because it was cancelled on 9/2, the date of termination! Don’t they have to, by law, cover me until I elect (or not elect) to continue coverage? State of Oklahoma

Most employers terminate coverage on the same day of end of employment. It's usually a courtesy if the employer agrees to extend to the end of the month. This happened to me once and when I left a previous employer, my last day was the 2nd of the month, and my insurance at the new company was not going to begin until the first of the next month. The next day I went to fill a prescription and my coverage was terminated. I did reach out to my employer but the amount of time it took to get fixed was nearly the entire month. I did not fight it because I had another job and decided to wait the few weeks and paid out of pocket for my prescription (which ended up being reimbursed). If you have a letter stating they were giving you insurance through the end of the month, they should be able to reinstate you, but it might take some time. Good luck!

Check with your specific state. In California, they cannot arbitrarily discontinue your health insurance. They can offer the COBRA as well at a reduced cost, based on your current income. However, the employer can decide to extend it if you need. I got mine for 3 months.

Thanks Debra I did contact HR. The assistant is looking into it since he fired the HR Director while we were shut down for COVID.

Sorry to hear about your termination. Don’t know about the laws in OK, but if your letter said that you were covered until 9/30, I would contact HR or benefits administrator and have them check. My coverage terminated at midnight the day I was let go. Even when I elected COBRA I experience my insurance being cancelled due to HR mishaps and had to contact HR to have coverage reinstated. They may just need to reinstate you.
