I’m currently in an ongoing lawsuit with my ex employer for pregnancy discrimination, harassment, and the loss of my job and benefits.
To the closing end of my pregnancy I began having very swollen feet as I had stood on them for about 8 hours a day my mom notices my feet (I mean how could she not) and said you need me be taking time off your feet at work is there a chair you can sit in and take orders or sit at the window or something) so I began sitting in a chair while under one manager at this job then one day she left and a young lady well call her Beth for now she had been at this store for about 3 months after her first 2 months she was promoted to assistant manager which I had been working my butt off for for about 2 years then her third months rolled around the current manager left and she became the general manager so I scooped in and put my hat in the ring for assistant I said hey you know me we work together for months you know I’m a great right hand woman and I have your back in a rush I’m great in all areas of this store I know how to call people to service machines heck I’ve talked to these men and women and I’ve learned a few things from them on how to trouble shoot sometimes instead of calling them to basically unplug and replay in machines lol anyway so her response to my interest in the AM (assistant manager) job was this and I quote “i would have no problem with that, I have 2 of you that I’m looking at my only concern is your maternity leave and mine we can’t both be gone” 1 not true the store will still be there and look we’re both gone anyway cuz she fired me and she had a baby and guess what she got replaced for the mean time just like I would’ve been an the store would still be there when we got back they wouldn’t leave a store without a gen manager lol so not only did she try to take my pregnancy into consideration for a job promotion (illegal) she also took it into consideration for NOT giving me a promotion (also illegal) so I let it go I was at least a shift leader at this time so I was happy waiting on a raise I was told about that me and a few would be getting then this new manager were calling Beth tells me that people have been complaining about me sitting in a chair and that we’re not going to do it anymore me being intimidated I said oh um ok I kinda need it who said we can’t sit in it anymore she says that she said it her store her rules and I said well we’re allowed to sit in a chair it’s the law and she says she doesn’t have time to do this then takes a couple orders (yes she came to the front of the store to have this chat not in an office setting in front of other employee and customers I was humiliated) she takes a few orders and storms off throws a headset stomps away yelling “telling me what the f—- we can and cannot do, this is my m-f- store I say what goes!” People are asking me what happened and I said I told her we were protected under law to receive accommodation (oh did I mention this boss was also pregnant and didn’t know her own rights let alone the rights of her employees) so days went by where I stood again for hours and hours so I made up my own idea I said to myself I’m pregnant I pee 8 times an hour anyway so I decided if I needed 3 minutes to myself I went to the bathroom didn’t always need to go but a sit was always good well it was until my next weekly doc appointment when he was very upset with me when I told him what was going on at work (he had asked like small talk “so how’s work going” and I had told him thinking you know idk he wouldn’t think anything of it but he did he said she’s breaking the law you’re entitled to sit to different job duties that cater to your pregnancy restrictions that day a change was made in my mind that when I thought I was in the wrong she was I went the next day and she said if I needed to sit that our district manager said I need a doctors note (SO. OW NOT EVEN THE DISTRICT MANAGER KNOWS THE RIGHTS OF THE EMPLOYEES—he’s a dude-not pregnant) so next day off I get the note come to work all is good week or so later the old manager comes back we’ll call her Jenny Jenny comes back and says she’s needs to speak to me as far as I knew I was excited to see her but I knew what was up by the look she gave Beth (current manager -undertrained/undereducated) anyway so I’m taken in the office with Jenny and Beth to discuss the chair issue as I’ve been calling it lol and didn’t know a third person was on the phone until the end of the meeting she was just quietly listening on the phone didn’t introduce herself at all anyway so Jenny tells me “honey you just can’t tell someone that you’re gonna sit in your chair and that’s that” and I said well that’s exactly what the law permits me to do Jenny then says the law says we have to find another spot for you and that would work if we had a front desk with a chair already there but we don’t have the means so we don’t HAVE to accommodate and I said that’s not what I was told Jenny asked by who I said my doctor my on coordinator my family oh AND A LAWYER whom I’d been in contact with prior to this meeting but had no case until I suffered a loss which happens later so long story short even after I stated the law and got a note in no longer allowed to sit I was told people were complaining about me that I’m in the way and that it’s not fair I’m sitting while everyone else is working when I’d sit people I once got along with were given a platform for dirty glares and sighs and comments under their breathe I can’t speak on knowledge but I know what she’s said to me about other employees so I could only imagine what was being said about me when the others went to her for support I’m assuming it went the same as it went when I complained about employees to her which was “ I know I’m sorry I’m gonna deal with it they know they’re not supposed to do that etcetc” basically a conversation I wasn’t supposed to be involved in which has happened before I was involved in a conversation where Beth when she was the assistant manager came to me and asked for advice whether to fire another employee (her cousin) or not for kissing repeatedly on the job I gave her my advice and said I’ve done your job I’ve done Jenny’s (former manager and assistant manager for this same job different location) you have a ship to sail when there are holes you patch them if there are broken sails you throw them out and get new ones unless you think they can be repaired I think you just need to sit down and decided if this employee is a hole and needs an uplifting conversation to fix the problem if this employee is a broken or torn sail and replacement is a must or if this employee is just in need of a repair but still has good stitching and preforms well is just in need of some patching up then ready for the high seas. I’ve used that tactic in every termination I’ve encountered I’ve never regretted a termination to this day bc I knew I wasn’t firing a good employee that just needed some help bc I’d think it out this same way that’s how I know every employee was rightfully terminated on just cause annnywaaay (so I don’t think I mentioned that during all this before the meeting and before I was told people were complaining I had asked our district manager what accommodations were being put in place for me hadn’t responded til one month later) later on before he responded got a call saying I am not to go above beths head that the order is to go to a shift leader then assistant then general then district I responded with a quote I got from the policy (which strangely enough as soon as I opened the lawsuit with them the company policies handbooks all resources disappeared from the employee website lol weird huh yea just you wait) the quote was “when responding to management with a personal concern, the employee should follow the appropriate order of command-shift lead, assistant, general, district- if the employee feels safe to do so and must distinguish that the proper order is followed for the appropriate concern” this basically states if I’m comfortable going to the next in command which at this point I wasn’t anymore she wasn’t doing anything so I went a step up which is very appropriate (especially since later in the phone call where she fires me she says “you’re not my only employee I have others things to worry about” where I then say well I’d make it your top priority then because you’ll be hearing from my lawyers-mic drop) the quote also means at the end that the employee is bringing the right concern to the appropriate form of management example you wouldn’t take sexual assault to a shift lead you’d go straight to management you wouldn’t take theft to a shift lead just like you wouldn’t FaceTime the ceo to ask if this torn $20 bill is acceptable lol just saying so anyway I was following policy she just wanted everything to go through her and that’s why something like this was able to happen so my pregnancy gets a little sticky and I require hospitalizations nothing too serious my first one I went back to work with permission from all sides of course. Before the hospitalization I informed my boss of this emergency as I had gone to a doc appointment on a day off and had work the next day same day as the hospitalization I said I could come in after she said no that’s fine take care of yourself I got to the hospital and was given a strict set of appointments for further hospitalization I sent those to Beth Beth confirmed and reassured me things were fine to take care of myself (we went back and forth being on good terms then bad when I brought up the law or basically didn’t ask how high when she said jump which this sucks cuz when she started 3 months prior to all these issues we were really good friends we had talks about what we were naming our babies and what our nurseries would look like we shared sonogram pics and Pinterest ideas we even shared tums I always had her back I was sour about getting passed up for assistant manager but so proud one of us was up there winning) (also on another note forgot to mention that on her first day of assistant manager I was really overworked and was asking a shift lead how to talk to Beth about feeling overwhelmed and she over heard it and took the conversation as “smack talk” saying anyone who has an issue can bring it to her not talk crap in the corner and I said ah I was not aware you were the manager yet and she said yes and if you have a problem with that you can go home without even a second to process what was going on I hear her dial up Jenny this was when Jenny was still the manager long story short I never got those 8 hours back I was so upset and pregnant lol I cried so much Beth later apologized but it wasn’t the end of our issues as you can see weeks later all this in this story happened) anyway so I thought I could make it back to work on my next scheduled day and I came in on a Monday morning and couldn’t even get out of bed but I stuck through it those were the most painful 8.47 hours of my entire life labor was nothing compared to standing in place taking orders sweating hurting swelling with acid reflux and then being put in the kitchen for 2 hours of that bending over still sweating still swelling now bending over rushing to make sandwiches her yelling I need this I need that (this was normal I was used to the regular kitchen shouting) anywho towards the end of my shift no where near the end of beths shift yet she had approached me purse and keys in hand ready to go to ask me an very “last straw” type of question. Beth asked me “are you taking your maternity leave?” I said yes I have plans of taking it I’m-“ (I was interrupted I was going to say I’m waiting of our district manager to get back with me about the paperwork which I had asked him for about 3 weeks ago before the hospitalization which also on the first day of the hospitalizations was when I heard back about my accommodations his response was “not yet” when I asked him that morning if he’d figure them out yet) so Beth asked “no I mean like are you trying to go on it now like you being out and stuff?” I said no I just have some complications am I doing something that makes you think I’m taking it lol why would I be here if I was taking it? Beth said “people are telling me that you’re taking it while still getting paid I was just checking” the first thing I have a problem with is that I keep getting told that people are bringing her info about me and I know it’s not being talked about in a professional manner bc of how she talked with me about other employees anyway that Monday was so bad my mom had to help me to the car I was so embarrassed I felt like a old person who needed assistance anyway helped me to the car and when I got home I was in tears (I forgot to mention why my bathroom breaks ended—she approached me once and said if I took too much longer in the bathrooms I’d need to clock out) (also forgot to mention that the meeting with the old manger Jenny and Beth and person on the phone well call her Jackie for now that meeting ended with me being told “if you need to sit you’re entitled to time to sit but yea if you need to you can clock out and take a minute” lol ok so hear me out I’m supposed to be treated equally right well let’s say that I wasn’t pregnant and instead broke my leg and have to stay off it for 6 weeks and I have to sit at my job...see where I’m going so I’d have to clock out for 6 weeks? Nah I didn’t think so I know my rights) anyway after that shift from satanville I told my manager I wasn’t able to come back after these visits and would return after they were over she assured me it was fine so I went with it (all in text by the way came in handy for the lawyer) next hospitalization came was even worse after so I just dealt with these the third one came and passed then my doc visit on October 9th 2020 said I wasn’t ready to have my daughter yet so I went home had one more hospitalization scheduled for that following Monday (the 9th was a Friday) and had all the plans of going to it doc said I wasn’t even close yet not even displayed lol on this day I was 39w2days lol I was done spent my baby had sucked all the food and biology out of me and my job drowned me rung me out and left me in the hot sun to bake and fade off lol least that’s what it felt like (also forgot to mention that I had a cold late feb 2020 and was pregnant so the doc told me with COVID being a thing in China and since I came off a cold my immune system was weakened she advised me to wear a mask I wore it bosses tried to tell me we couldn’t and I said there’s nothing in the policy about face coverings the district same district as now told me to stay home until I feel better I said I’m not sick I’m just at risk of getting sick cuz I just came off a cold he said still a good reason to stay home and get better so I was out sick for 3 weeks at first then when I came back was told to stay home til I felt better until I healed from a weakened immune system so I just thanked god for the time off but struggled with money I was out for 3 weeks in my opinion unlawfully and should’ve been paid since I was literally pushed out like if I had gone back to work I felt I would be in the wrong when should anyone feel that way) anyway so I text the district about my raise which I was supposed to get by sept 15 2020 and this was now October and still nothing said he talked to Jenny and she said nobody was promised a raise but on august 1st I was awarded employee of the month which felt like an honor I had worked this job and I worked it hard and I really like finally getting some recognition after almost 2 years and nobody noticed someone finally did so it didn’t come to a surprise when Jenny told me she put me in for a promotion and to go ahead and start wearing my uniform to work I was so excited a new baby new promotion new recognition like y’all I felt on top of the world so then later when Jenny left and I started raising heck about the chair Beth got upset a lot and made my job harder when I’d try to train and do my job how I’ve always done it and never been told I was doing anything wrong was actually congratulated on doing great but now since I was pushing her buttons she was gonna show me my place I guess by wrongfully reprimanding me I tried to train someone by saying hey so next time put the ice in first it’s much easier and is part of the drink making process and is compliant policy Beth says really loud “I think he’s doing fine” with a snicker and a grin and just a total high school bully mean girl vibe like really girl low blow I’m just doing my job a job I actually enjoyed before she started making it harder and even then I tried my hardest to enjoy it I just stuck it through those last few weeks without my chair came home and soaked my feet drank lots of water all day brought lots of water fruit and veggies to work even though whenever I’d try to eat was also reprimanded for leaving my post and was denied several times for our entitled 10 minute breaks never got a break in the 4 years I worked for this company I’ve worked all hours of shifts 8,4,6, 12-15 sometimes doubles where’d I’d leave at 3:30am be there by 4:00 open and stay clocked in go to another store and then another and clock out by 9:30pm before pregnant lol but never had a break not once) so I received a call from Jenny after I texted her about my raise and she goes on speaker and my mom can hear her she goes on about how she put me in but that didn’t mean I had the job that someone still had to approve me (one if so why’d you tell me to where that uniform if I wasn’t getting paid any kind of raise) well I asked her that and her response was the dumbest thing I’ve ever heard it was this-“well honey I wanted the other employees to see you in that light to see you as a shift leader” ummm what (and this has happened to me before in an not so similar way October 2019 my boss well call her gabbie she had her baby and our assistant stepped up well the same assistant also stepped up to manage a separate store and got overwhelmed ultimately resulting in her quitting so I stepped in I told them I had management experience and could step up was under the impression I’d be getting paid spent many hours off the clock planning for the next day doing extra chores to make sure the next shift came in on a happy note and they’d leave the store the same for us in the am it was great the store ran smooth times were great I felt that manager rush I missed so much and knew that right now could be my time so I shined y’all I shined so hard and then gabbie came back before her leave was up and brought her baby which I had no problem with this was before I was pregnant but I loved babies and got to hold him sometimes I loved it but just shows that they had to bring her in during her leave bc the people above her and me are incompetent anywho so my time was not then and it wasn’t with Jenny and then it wasn’t when Jenny left so I kept getting passed up and was getting frustrated so 2 weeks before I was terminated before I knew about the hospitalizations I applied for another job same business type just different company I wanted to start over my job that I once loved had turned to something that I didnt even want to go back to after my leave I didn’t get hired yet I couldn’t help but think it was bc I was pregnant and about to go on leave which I understood but was still disappointed so back to the phone call with Jenny so I hang up with her she never says sorry for the confusion to this day I think she knows what she did she got shift leader work out of someone for free and she’ll never be held accountable for it or for lying about what rights I have so then I get a call after I text Beth and Beth starts out sort of upset saying I’m not her only employee this was the call I referenced above she says I’m not her only employee—forgot to mention there was other calls before this where she says I’ve been overstepping a lot and need to stay in my place and I could hear people laughing in the background
