Unfortunately it is especially if you are in an at-Will state. Now there could be risks for the org that could lead to possible legal action- depending on many factors- ie- what laws may be impacted, how different was the new job, why not let previous employee know the job was being downgraded and given opportunity, what current laws (still in play) could be applied, etc?

Yep it is legal. They eliminated a role that no longer serves their purpose. They reposted and had an internal candidate. That’s how they remove dead weight (aka people they want out but firing them could result in a legal battle). If they fired your manager then they have decided they want someone else, thus the new role was created. Sometimes this is called a reorg. I’ve seen it happen. It’s legal but it also shows you, very loudly, the way your company operates.

You meant “purpo$e.” Seems that they just wanted to downgrade the role. That sort of happened when a. p left my company and was replaced by a “Senior Executive Director.” Before that, we never even knew such a role existed
