Have you won an appeal against your State's employment organization for being forced to resign?

I was bullied and harassed for 2 years, including a salary and job category downgrade from a union negotiated contract, a toxic boss, unsubstantiated performance reviews and an eventual PIP attempt being placed on me before I finally quit.

The experiences were emotionally and physically traumatizing. I was so sick of fighting back and defending myself. I documented and saved everything however, a slick narcissist knows not to leave a paper trail so my unemployment claim got denied. I fought the union salary downgrade internally but it went nowhere.

There are TOO many of you/us who have posted about these horrible experiences.

I suspect there may be a lot of unemployment claims submitted for these reasons and wonder how many have won appeals in your defense due to the abuse and harassment you endured?

I know you are not eligible to collect unemployment if you quit however, if you dig into cause/affect wording, you'll find there are areas such as "constructive discharge" or "quiet firing" that can be exceptions to that rule.

Sorry that you are going through this difficult situation. An employment focused lawyer would best be able to assist you.

I was in a different situation... fired (after 18 yrs!) being accused with something I was not responsible for. I fought HR for months to agree to let me collect unemployment. Finally after almost 6 months, I received unemployment AND severance in addition to my record being cleared of wrongdoing. And it took me a year to find a new job, as we were amidst the worst recession 2009-2010!

    Best of luck to you.

Sorry you are going through this.

I went through a similar experience. I was given the option to quit or be fired. They said they wouldn't contest unemployment, but the did just that. I had to file an appeal. After several months I finally got unemployment approved.

It has been years and I'm still dealing with the aftermath and trying to get back on my feet.

where was your union rep throughout this debacle? Sounds like they failed you.

Union reps were ineffective cowards and sided with higher ups.

I'm sorry you are going through this. Yes, I have gone through the appeal process, and I won. My situation was much different, however. The company was trying to disguise a lay-off/reduction in force/restructure as a termination for cause. Several months before they terminated me, they put me on a PIP for paperwork errors, and it had expired with no new paperwork problems. The reason for termination was utterly different from what the PIP was for and for something not even remotely related to my JD. They tried to appeal that I was terminated "for cause" and even brought an attorney to the hearing. When I (without an attorney) showed the PIP write-up and the termination paperwork, which didn't match, the person (I think they called him an appeals judge) chewed out both my former boss and the attorney while I was still there. I won the appeal. I live in a right-to-work state, but to avoid paying unemployment benefits when a company terminates an employee, they must show cause. My company was trying to get away with incurring the increase in their unemployment benefits for laying me off, as that is the real reason they let me go. They never filled my position after I was gone.
