My work is making me reapply to my job position.

My work is making me reapply to my job position.

My company started restructuring and I’ve been asked to reapply to my position as it will change the job description and title. Once applied, there will be an interview process. The job position will be available to everyone within the company to apply, so if not selected, I would end up with no job. Would I be able to qualify for unemployment while I look for a new job?

Yes. In this scenario, you would not be fired, your position would be ending.

Not until they let you go/lay off/fire you

Yes. Once a layoff is documented.

Absolutely, you would qualify for unemployment, but if you are paid severance, probably not right away. I would still apply, though. The unemployment office can give you an idea of when you’d be eligible and how to proceed. That happened to me when I was laid off in mid April last year and received severance nearly equivalent to four months of pay—I was told I wouldn’t be eligible to receive unemployment payments until mid August, but to keep my claim active, I had to continue requesting payments every two weeks.

Yes, definitely. If you're paid severance, whether or not you can get unemployment depends on your states. Some states do not consider that "earned" income so you still receive unemployment.

Yes, assuming you have worked the minimum time there to be eligible. Check your state's UI eligibility requirements to see how long that is. Effectively, you are being laid off and eligible for rehire (potentially immediately) in a corporate restructuring. If you don't get rehired, the termination will stand and it will be considered a "reduction in force or RIF".

So, I am going through this right now. They gave us until April 1 to re-apply for the available roles (which were not a 1:1 match). In NYS at least, yes, you are eligible for unemployment because your current position is being eliminated and the new job constitutes an entirely new position.

    Yes

Check your state laws but you should be able to get unemployment if you are let go because your position was eliminated. Hopefully you will rock the interview and keep your job, but if you don't, ask your HR person if you are "eligible for rehire."
