Subcontractor here..

one of the clients has not provided 2025 PO to owner of the firm for which I am employed for me to get paid for my services. Is the PO underway? Yes.. but totally mismanaged by the owner of the firm. Total bureaucracy at the client... One hand passes if off to another for signature. The client knows the Economic Benefit of our work and continues to request our assistance on projects. Yess..... I know .. why did I work without the PO? I trusted the firm for which I am employed as we are entrenched at the client.. Do I think I will get paid? Yes.... but today, I blew a fuse! The owner of the firm requested me to provide a report with a quick turnaround time for the client's budget. I said to her (in a loud tone!) We are jumping hoops for them... why don't you ask for that PO? She said, I know.. I know.. .working it........ It is such abuse... but she knows I have alot of $$$ pending.... .. Stressed to the max. I want to get paid... and leave! Your thoughts?

Depends how much you need the money. Can you walk without another job?

  2. Anonymous

I could walk.. will be a big dent in the finances.. but I may consider

Stick around until you get paid.

What else do you have in mind?

Just don't allow it to push you to the point of being unprofessional. That just makes you look bad.

Makes sense... agree being unprofessional will not be good and I am not. Although very difficult to interact with the owner and jump through hoops for the client as She needs to move this signed PO along.

How is your agreement with the agency you work for worded? Do they require the company to pay them before they pay you? Since they know you are working, and this is an entrenched client, what's the problem? This does not sound legal to me. They are the ones paying you, not the client company, so basically, you are working for free. You may want to consult with an attorney who works with consulting contracts. Please correct me if I don't understand how your contract works.

Yes, I get paid when the firm for which I am providing consulting services is paid by the client. Yes I am working for free. Unfortunately I am continuing to work without a signed PO. Based upon my allegiance and trusting we will receive a PO. My contract does not state that I will not provide consulting work without a signed PO. The firm for which I provide consulting services is not a huge corporation.. small firm- have worked for them for 25 years. Your thoughts? Hope that explains it

It sounds both illegal (wage fraud if you were a W-2 employee) and a hard place to be. You may still want to meet with a contract attorney who understands your state's labor laws, as 1099 employee rights are significantly different in each state. Contacting an attorney on this could jeopardize your relationship with the agency and keep you from any future contracts. The most significant determining factor should be: How long can you last without a paycheck?

Yes agreed... how long can I last.... contract attorney is in my thought and at this point jeopardizing my relationship doesn't matter. I will give myself a deadline and then pursue. Lesson learned ... the hard way. Thank you for your insight!!
