Hi Question for the community

Hi Question for the community - I was offered a FT job with a company based in the UK but I will work remotely 8 hours a day in NYC. I would be their first employee in this situation - how do the taxes work and assume they can pay me via EFT. Thank you for your help and guidance

I would ask these questions directly of them.

They haven’t hired this way before so they don’t know

    Agree 100%!

You will end up paying taxes in both countries, so make sure the pay is worth the hassle. I turned down a position I had previously accepted once because of that fact. They weren't willing to offer better pay or hours of benefit package because of that fact, so I had to tell them I withdraw my candidacy.

    This sounds incorrect to me.

You need to ask their compensation team, they should be international subject experts.

It's their job to cover ALL laws pertaining to their work force

So incorrect. Respectfully. They need to know who to partner with. Even a small company has payroll experts and lawyer to seek correct information from. If not, they're putting themselves at a risk and if they're hiring internationally they really should have the people to go to with these questions. Bigger companies and smaller companies don't operate at the same level.

Absolutely they need to figure it out...not their new hire!

Agree, It is Not HR's job to cover ALL Laws, what their responsibility is to know WHO to partner with or to redirect. Now, if it's a small organization they may be the 'go to' person, but NOT the Law expert. Why do people think that HR is also Law Experts, welcome door to liability land! So important to know what any specific HR employee does and it's parameters, not all created equal.

Unfortunately companies are responsible or they hire out to a 3rd party that can take care of that for them.

If they didn't want the responsibility, then they simply do not hire outside their expertise.

Not knowing the law is not a defense. The company is ALWAYS responsible for their business practices regardless of where that takes them. Saying you don't know doesn't let you off the hook.

I don't think anyone on here is saying 'not knowing the law is a defense'. Yes, ultimately it is the responsibility of the company, point is and has been who it can land with to be that subject matter expert. I think there's a clear professional miss here. Short story >> lean into the company law expert.

The company must take full responsibility to follow the law regardless of where that takes them so they either take care of that knowledge and responsibility in-house or they hire outside experts who will take are of that. That is what counsel is for. To make sure laws are upheld and paperwork is legally binding and explicit. If the company doesn't want the responsibility then they do not hire or conduct business outside their territory. in those territories. Saying you don't know how to address international legalities is not acceptable on any subject if that is part of your business practice.

Then they should easily be able to take responsibility and explain the tax situation to a new hire.
